1. Acceptance of Terms

By accessing or using the PugetNest website, applications, and related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use our Services.

PugetNest ("we," "us," or "our") is a property management platform serving the Puget Sound region of Washington State. These Terms govern your use of our website, SMS communications, tenant portal, and all related services.

2. Eligibility

You must be at least 18 years of age to use our Services. By using the Services, you represent and warrant that you meet this requirement.

3. Description of Services

PugetNest provides property management services including, but not limited to:

  • Rental property listings and inquiry management
  • Tenant communication via SMS, email, and web portal
  • Maintenance request submission and coordination
  • Lease management and renewal processing
  • Rent collection and payment processing
  • Property showing scheduling

4. SMS Communications

By providing your phone number through a rental inquiry, lease agreement, or by texting our number, you expressly consent to receive SMS messages from PugetNest related to property management services.

Types of Messages

SMS messages may include:

  • Responses to rental inquiries and showing confirmations
  • Maintenance request updates and contractor scheduling notifications
  • Lease renewal reminders and property notices
  • Rent reminders and payment confirmations

Message Frequency & Costs

Message frequency varies based on your interactions with our Services. Standard message and data rates from your carrier may apply. PugetNest does not charge for SMS messages.

Opt-Out

You may opt out of SMS communications at any time by replying STOP to any message. After opting out, you will receive a confirmation message and no further SMS messages will be sent unless you re-subscribe. To re-subscribe, text START to our number.

Consent & Third-Party Sharing

SMS consent is not a condition of purchasing any property, signing a lease, or obtaining any service from PugetNest. We will not sell, rent, or share your phone number or SMS opt-in consent with third parties for their marketing purposes.

5. User Accounts & Responsibilities

When using our Services, you agree to:

  • Provide accurate and complete information
  • Maintain the confidentiality of any account credentials
  • Notify us promptly of any unauthorized access or security breach
  • Use the Services only for lawful purposes related to property rental and management

You are responsible for all activity that occurs under your account or phone number.

6. Prohibited Conduct

You agree not to:

  • Use the Services for any unlawful or fraudulent purpose
  • Submit false or misleading information in rental applications or inquiries
  • Interfere with or disrupt the operation of the Services
  • Attempt to gain unauthorized access to any part of the Services
  • Use automated means (bots, scrapers) to access the Services without our prior written consent
  • Harass, abuse, or harm other users or PugetNest staff

7. Intellectual Property

All content, features, and functionality of the Services — including text, graphics, logos, and software — are owned by PugetNest or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without our written permission.

8. Third-Party Services

Our Services may integrate with or link to third-party platforms including rental listing sites, payment processors, and communication providers. Your use of those third-party services is governed by their respective terms and privacy policies. PugetNest is not responsible for third-party content, practices, or availability.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. PUGETNEST DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PUGETNEST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF PUGETNEST HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

11. Indemnification

You agree to indemnify and hold harmless PugetNest, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Services, violation of these Terms, or infringement of any third-party rights.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Services shall be resolved in the courts of Washington State.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Your continued use of the Services after changes are posted constitutes acceptance of the updated Terms.

14. Termination

We reserve the right to suspend or terminate your access to the Services at any time, with or without cause, and with or without notice. Upon termination, your right to use the Services will immediately cease.
